Terms of Service

The official PisgaX Terms of Service.

These Terms of Service (“Terms”) govern access to and use of the PisgaX website, documentation, developer tools, AI skills, software projects, and related materials (the “Services”). PisgaX is operated from Accra, Ghana.

By accessing the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. What PisgaX provides

PisgaX presents software, developer tools, technical documentation, AI skills, experiments, and project information. Some materials may be downloadable or installable. Availability, features, support, and licensing may differ by project.

Project-specific licences, notices, or end-user licence agreements control where they impose terms specific to that project. If a project licence conflicts with these Terms for that project, the project licence controls to the extent of the conflict.

3. Eligibility and lawful use

You may use the Services only if you can legally agree to these Terms. You must comply with applicable laws, regulations, export controls, sanctions, intellectual-property rights, and third-party terms.

4. Acceptable use

You must not:

  • Attack, disrupt, overload, probe, or bypass security controls of the Services.
  • Upload malware, credentials, unlawful content, or another person’s private information without authority.
  • Scrape, mirror, or systematically copy the Services in a way that burdens or misuses them.
  • Use the Services to facilitate fraud, harassment, abuse, unlawful surveillance, or other unlawful activity.
  • Misrepresent PisgaX, impersonate another person, or falsely imply endorsement.
  • Reverse engineer or redistribute software except as permitted by its applicable licence or law.

5. Software and project materials

Software and project materials may be experimental, incomplete, or unsuitable for production use. You are responsible for reviewing documentation, licences, dependencies, permissions, security implications, backups, testing, and compatibility before installation or deployment.

Do not install or run software from PisgaX on systems or data you do not own or have authority to administer. Do not provide software with secrets, credentials, personal data, or production access unless the relevant documentation expressly supports that use and you have assessed the risks.

6. Intellectual property

Except for third-party material and material released under a separate licence, PisgaX and its licensors retain rights in the website, branding, documentation, original code, design, and content. These Terms grant only the permissions expressly stated. Third-party open-source licences remain applicable to their components.

You must preserve copyright, attribution, licence, and notice requirements when using permitted material.

7. AI-generated and technical content

Some Services may use automation or AI-assisted generation. Outputs may be inaccurate, incomplete, non-unique, or unsuitable for a particular purpose. You are responsible for reviewing outputs, checking rights and originality, and making final decisions before use.

8. User communications

If you submit a contact message, feedback, issue, or security report, you confirm that you have the right to provide it and that it does not knowingly violate law or another person’s rights. Do not submit secrets or sensitive personal information through public channels.

A contact submission does not create a contract, employment relationship, partnership, sponsorship, agency, or confidentiality obligation unless PisgaX separately agrees in writing.

9. Security reports

Do not disclose security vulnerabilities through public GitHub Issues. Report them privately to security@pisga-x.com. Keep testing within an authorised, non-destructive scope and do not access, copy, retain, alter, or disclose data that is not yours.

11. Availability and changes

PisgaX may change, suspend, remove, or discontinue any part of the Services without guaranteeing advance notice. We do not guarantee that the Services will always be available, accurate, secure, error-free, or compatible with your environment.

12. Disclaimers

The Services are provided for general informational, educational, and engineering purposes. To the fullest extent permitted by law, PisgaX disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, PisgaX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss of data, profits, revenue, business, goodwill, or opportunity arising from use of or inability to use the Services.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or legally non-excludable personal injury or consumer rights.

14. Indemnity

To the extent permitted by law, you agree to indemnify PisgaX against claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, violation of these Terms, infringement of third-party rights, or negligent or harmful installation or deployment of software.

15. Privacy

Personal information is handled under the PisgaX Privacy Policy. That policy explains contact-form processing, service providers, retention, cookies and similar technologies, and privacy requests.

16. Suspension and termination

We may suspend access where reasonably necessary to protect the Services, users, or third parties, investigate abuse, comply with law, or address a security risk. Clauses concerning intellectual property, disclaimers, liability, indemnity, privacy, and dispute resolution survive termination where applicable.

17. Governing law and disputes

These Terms are intended to be governed by the laws of Ghana, subject to mandatory consumer-protection or other rights that apply to you in your country of residence. Before starting formal proceedings, contact legal@pisga-x.com so the parties can attempt to resolve the issue informally.

Nothing in this section removes mandatory rights to bring a claim in a competent court or tribunal.

18. Changes to the Terms

PisgaX may update these Terms as the Services or applicable requirements change. The “Last updated” date identifies the current version. Continued use after an update means that you accept the updated Terms to the extent permitted by law.
